California Consumer Privacy Act Certification.
This CCPA Certification (“Certification”) is made by and between CallTower, Inc. (“Vendor”), a Utah corporation, with its headquarters at 10701 River Front Parkway 4th Floor South Jordan, UT 84095—including its subsidiaries and affiliated entities—and you (“Customer”) ( each a “Party” and collectively, the “Parties”). This Certification, dated as of the date last signed below, is incorporated into and forms a part of the master agreement, purchase order, other terms, invoice, terms of service, or any agreement between the Parties (collectively the “Agreement”) under which the Vendor provides services to Customer.
This Certification sets forth the terms and conditions relating to compliance with the California Consumer Privacy Act of 2018, Cal. Civil Code § 1798.100 et seq., (“CCPA”) and related regulations, as may be amended from time to time. In the event of a conflict between this Certification and the Agreement, this Certification will control when applicable. Capitalized terms identified in this Certification shall have the same meaning as defined in the CCPA, unless otherwise noted. The Parties agree as follows:
- Vendor is a Service Provider and not a third party as described in the CCPA. Therefore, Vendor shall not:
(a) Sell the Personal Information Vendor receives pursuant to the Agreement.(b) Retain, use, or disclose the Personal Information Vendor receives pursuant to the Agreement for any purpose other than providing the services specified in the Agreement. Moreover, Vendor shall not retain, use, or disclose the Personal Information provided by Customer for a Commercial Purpose.
(c) Retain, use, or disclose the Personal Information outside of the direct business relationship between Vendor and Customer.
Vendor certifies that it understands its obligations under this Agreement and the CCPA and will comply with those obligations.
